Terms of Use

Welcome to the website of National Filter Service (“NFS,” “we,” “our,” or “us”). By accessing or using this website or any associated platforms, including any client portals or service verification tools such as our SERVICE TRACKER system (collectively, the “Site”), you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree, you must not access or use this Site. 

These Terms apply to all visitors, clients, subcontractors, and any other users of the Site. 

1. Acceptance of Terms 

By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you use the Site on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Changes to Terms

NFS reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Site. Continued use of the Site constitutes acceptance of the revised Terms.

3. Use of the Site

You may use the Site solely for lawful purposes and in accordance with these Terms. You agree not to: 

  • Access or use the Site in any manner that could damage, disable, overburden, or impair any NFS systems. 

  • Attempt to gain unauthorized access to any accounts, systems, networks, or data. 

  • Use the Site to engage in fraudulent, criminal, or harmful activity. 

  • Interfere with or disrupt the integrity, security, or performance of the Site.

4. SERVICE TRACKER and Client Platforms

NFS may provide access to proprietary systems, including SERVICE TRACKER, client portals, and verification technologies (collectively, the “Platforms”). If you are granted access: 

  • You agree to use the Platforms solely for purposes authorized by NFS. 

  • You are responsible for maintaining the confidentiality of your account credentials. 

  • You agree that all data, analytics, reports, and documentation generated through the Platforms are proprietary to NFS or its licensors. 

NFS may suspend or terminate Platform access at its discretion for any violation of these Terms.

5. Intellectual Property

All content on the Site, including text, graphics, logos, service descriptions, images, videos, software, and tools, is the property of NFS or its licensors and is protected by applicable intellectual property laws. 

You may not copy, reproduce, distribute, sell, modify, or create derivative works from any content without prior written authorization from NFS.

6. No Warranties

The Site and all content are provided “as-is” and “as available,” without warranties of any kind, either express or implied. NFS disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. 

NFS does not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses.

7. Limitation of Liability

To the fullest extent permitted by law, NFS shall not be liable for any indirect, incidental, consequential, special, or punitive damages—including loss of profits, revenue, data, or business opportunities—arising out of or related to your use of or inability to use the Site. 

In no event shall NFS’s total liability exceed one hundred dollars ($100) or the minimum amount required by applicable law.

8. Third-Party Links

The Site may contain links to third-party websites for convenience. NFS does not endorse and is not responsible for the content, privacy practices, or services of any third-party sites.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and safeguard information. By using the Site, you consent to the practices described in the Privacy Policy.

10. Prohibited Conduct

You agree not to: 

  • Use the Site or Platforms for unauthorized commercial purposes. 

  • Impersonate any person or entity, or misrepresent your affiliation. 

  • Upload or transmit viruses, malware, or harmful code. 

  • Scrape, data mine, or use any automated systems without written permission.

11. Termination

NFS may terminate or suspend access to the Site or Platforms at any time, without notice, for conduct that NFS believes violates these Terms or is otherwise harmful to NFS, its clients, or the public.

12. Governing Law and Dispute Resolution 

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. 

Any disputes arising under or in connection with these Terms shall be resolved through good faith negotiations. If not resolved, disputes will be submitted to mediation in the Commonwealth of Virginia. If mediation is unsuccessful, disputes shall be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction.

13. Indemnification

You agree to indemnify, defend, and hold harmless NFS, its affiliates, employees, agents, and subcontractors from any claims, damages, losses, liabilities, or expenses arising from your use of the Site or violation of these Terms.

14. Electronic Communications

By using the Site, you consent to receive communications from NFS electronically. You agree that all terms, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and NFS regarding use of the Site.
